1. Who you are contracting with
The Ground Zero service (“Ground Zero”, “Service”) is provided by Williams & Co. Enterprise (“we”, “us”). By creating an account or using the Service you agree to these Terms.
2. The Service
Ground Zero provides digital study resources for nursing students, including reference guides, interactive case studies, question banks, and progress tracking.
3. Eligibility and accounts
You must be of legal age in your jurisdiction to enter into these Terms. You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.
4. Acceptable use
You must not:
- Use the Service for unlawful, fraudulent, or abusive activity.
- Send spam or unsolicited communications through the Service.
- Infringe intellectual property or other rights, including by redistributing our content.
- Interfere with the security of the Service, including probing, scanning, uploading malware, scraping, or attempting to circumvent access controls.
- Share your account, resell access, or use the Service on behalf of another party without our permission.
5. Intellectual property
We and our licensors retain all rights, title, and interest in the Service and its content, including software, text, graphics, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service for personal study within your active plan. You may not reverse engineer, resell, or redistribute the Service.
6. User content
You retain rights to content you submit (for example notes, answers, or feedback). You grant us a limited license to host, store, and process that content solely to provide and improve the Service.
7. Payment, subscriptions, and refunds
Payments are processed by Stripe, our payment processor. Payment, billing, cancellation, and refund mechanics are governed by our Refund Policy. Applicable taxes are calculated and collected at checkout.
8. Service availability and warranties
We work hard to keep Ground Zero available and accurate, but we do not guarantee that the Service will be uninterrupted, error-free, or that content is free of mistakes. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. The Service is a study aid and is not a substitute for professional medical or clinical judgment.
9. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law, such as for fraud, death, or personal injury caused by negligence.
10. Indemnity
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
11. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel your subscription at any time from your account. When your access ends we may delete associated content after a reasonable period.
12. Changes
We may update these Terms from time to time. If changes are material, we will highlight them on this page. Continued use of the Service after changes take effect means you accept the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Williams & Co. Enterprise is established, without regard to conflict-of-laws principles. Disputes will be brought exclusively before the competent courts of that jurisdiction, unless mandatory law provides otherwise.
14. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
15. Force majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control.
